Delhi High Court Rejects Challenge to Income Tax Exemption for Agriculture Sector
On Wednesday, the Delhi High Court dismissed a Public Interest Litigation that had challenged the long-standing policy of granting complete tax exemption to agricultural income in India.
The petition was heard by a bench comprising Chief Justice D K Upadhyaya and Justice Tejas Karia, which took a firm view that the plea was fundamentally flawed in its maintainability. The court observed that the arguments raised in the petition did not fall within the scope of judicial review and instead pertained to policy matters that are exclusively within the domain of the legislature.
Terming the petition as “misconceived,” the bench clarified that the judiciary cannot interfere in legislative functions or issue directions compelling the government—whether the Delhi government or Parliament—to introduce or amend tax laws. The court emphasized that framing a taxation framework is a legislative function and not something that can be mandated by judicial orders.
Further examining the relief sought by the petitioner, the bench noted that the essence of the plea was a request for the court to direct lawmakers to enact a specific law regarding taxation of agricultural income. The judges stated that issuing such a mandamus would be contrary to established constitutional principles and would amount to encroaching upon legislative powers.
Finding the petition legally untenable and beyond judicial competence, the High Court dismissed the PIL in its entirety.
