S.O. (E).-
In exercise of the power conferred by sub-sect ion (1) of sect ion 637 of the Companies Act 1956 (1of 1956), and in supersession of the not ificat ion of the Government of India, in the then Department of Company Affairs, number G.S.R. 222(E), dated the 17th March, 2011, except as respects things done or omitted to be done before such supersession, the Cent ral Government hereby delegates to the Regist rar of Companies, the power and funct ions vested in it under the following sect ions of the said Act , subject to condit ion that the Cent ral Government may revoke such delegat ion of powers or may itself exercise the powers and funct ion under the said sect ions, if in its opinion such a course of act ion is necessary in thepublic interest , namely :- (a) sect ion 21, (b) sect ion 25, (c) proviso to sub sect ion (1) of sect ion 31, (d) sub sect ion (1D) of sect ion 108, (e) sect ion 572.
2. The powers and funct ions under sub-sect ion (1D) of sect ion 108 shall be exercised and performed either by the Regist rar of Companies of the State in which the registered office of the Company is situated, or by the Regist rar of Companies of the State in which the applicant ordinarily resides.
