PIL filed in SC seeking a stay on opt-out scheme of ICAI for CA July exams

Public interest litigation, PIL has been filed in SC seeking cancellation of the opt-out scheme introduced by ICAI for CA July exam 2020- The petition also seeks some extra centres or the appearing candidates.
Institute of Chartered Accountants of India, ICAI had given its candidates the option to opt-out of exams on June 15, 2020. The candidates who had applied for May exams could fill the application until June 27, 2020. Now a petition has been filed in the apex court asking for a stay on this opt-out scheme calling it a violation of fundamental rights of students. The PIL in Supreme Court also sought more examination centres for the conduct of July CA Exam 2020.
This year about 4.67 lakh students are appearing for CA examination to be conducted between July 29 and August 16, 2020. The earlier dates were postponed after the pandemic outbreak followed by a nationwide lockdown.
The petition filed by Alok Srivastava on behalf of India Wide Parents Association is scheduled to be heard in the coming days. It has claimed that the notification issued by ICAI on June 15 violates the fundamental rights of the students. The exams of the may cycle of ICAI were to be conducted in July- August in wake of COVID-19 cases in the country.
ICAI had then after taking note of various student protests on their inability to travel for exams had given an opt-out option to students which allowed them to not appear in the July exams and take exams in the month of November. ICAI also said that the attempt of the students who had already applied for the May exams would not be counted in case they chose to opt-out.
The petition raises questions for those candidates who are situated in the remote areas of the country or are living in containment zones. It says, “the 'opt-out' option discriminates between those underprivileged group of CA students/ aspirants, who are living in remote areas of the country or living in the containment zones and thus are slated to lose one precious 'examination attempt' by choosing 'opt-out' option amidst ongoing COVID-19 pandemic, as compared to that privileged group of students/ aspirants, who are living in big cities/ green zones and thus they have no problem in appearing in the said examination.”
The petition asked the court to squash the notice released by ICAI on June 15 ask the examination body to increase the number of centres so that all students could attempt the exams in one go. It demands at least one centre per district across India. ICAI has arranged for 4.67 lakh aspirants to appear at about 259 examination centres in India and five centres overseas. #casansaar (Source - Times Now)
