Please Help: Capital gain

Assesse has came to an agreement to sell property in month of may , though the agreement is not registered , the stamp value as on date of agreement is considered selling price , the assesse also calculated and paid the capital gain on such amount & sale agreement is done in month of may .
know A.O is asking to pay capital gain on stamp value as on selling date .
