my query is related to HRA.i am working in a payroll section in a company.there is a provision regarding submitting of PAN that it will be submitted when rent goes above 180000 in a year.so what the employees is doing they are submitting the PAN of their wife showing that they are paying rent to their spouse however in some cases their spouse is even not filling return as income is below taxable limit.i am little confused whether it is genuine to do so.Plz help me

dear Rachit ji, in my opinion It is, as if the House is named on spouse/wife's name, and the income will be deemed income of the employee. Hence, it is genuine... Hope this may clear ur doubt....

In this case the clubbing provisions will be applicable and the rent income will be ultimately be taxable in hands of employee only.

07-Mar-2012 , 01:54:20 pmSIR HRA WILL B EXEMPT ONLY WHEN, IF ASSESSEE HAS NOT THEIR OWN HOUSE IN A WORKING AREA, & UNDER DEFINATION OF OWN HOUSE, HIS SPOUCE & RELETIVE ALSO INCLUDE SO IN THIS CASE HRA WILL BE NOT EXEMPT I.E HRA IS FULLY TAXAXBLE.
