Assesses had not received any notice for 2 years from the end of financial year in which return was due. so it will be considered that this assesses is exempted for filling the return for that financial year in which the returns was due.

No, the assessee can still be covered under section 132 provision 3, if i am not wrong.

Its wrong perception. Every person whose taxable income exceeds basic exemption limit liable to file income tax. When IT authorities came to that not filing return then they will proceed further regarding penalities.
