LETS EG. XYZ(PROPRITORSHIP) INDIA TAKE LEGAL CONSULTANCY IN UK FOR OPENING A CO. IN UK. AND PAYMENT IS GIVEN FROM XYZ INDIA WHETHER TDS IS DEDUCTIBLE U/S 195. IF YES HOW MUCH & WHICH SECTION IS APPLICBLE.

Yes TDS should be deducted at rate prevailing as per DTAA or Finance Act which ever is beneficial to assessee.
