Please Help: Yet not have 12a

We are a registered in 2004 as charitable trust and getting audited every year but did not apply for 12 a because we do not have permanet office but on rent changing every year.Can I apply now because I have now a rent deed for 5 years.Is there any penalty have to pay for that.
