Yes, you should pay service tax by grossing up the monthly invoice along with interest on delay payment of service tax. Though the notification number 25/2011 is effective from 01.04.2011 and accrual basis payment of service tax is effective from that date.If you have raised the bill of rental along with service tax and you could have not received the rental alongwith service tax from your tenant then, you were not respossible for payment of service tax to the department. For the FY 2011-12 it was on accrual basis. However we understood that you you have received the rental from your tenant for both the financial year and raised the bill of service tax separately for both the financial year. In that situation whether you have received the service tax from your client , you have to pay service tax by grossing up the rental income alongwith interest on delay payment of service tax.
