Construction of Commercial Property would be chargeable under Construction of Complex Service even if it is constructed/devloped under Joint Development Agreement.

Thanks a Lot Saurabh for Quick Reply, Can you cite a justification for such a treatment? because as per the recent judgement of Supreme Court, builders in maharashtra are required to pay VAT on under constructed properties and if this transaction is liable for VAT, then the service would fall under Works Contract Service.
