It depends on what type of property it is.... There are certain exclusion from the scope of levying service tax on immovable property.

Yes, "Renting of Immovable property Service" Sec.65(90a) If immovable property use in course or furtherance of business or commerce. But does not include- 1. Vacant land solely used for agriculture, Farming, Forestry, animal husbandry, mining purpose. 2. Vacant land, where or not having facilities clearly incidental to the use of such vacant land. 3. Land use for educational, sports circus, entertainment and parking purpose. 4. Building use solely for residential purpose and buildings used for the purpose of accommodation, including hotels, boarding house, holiday accommodation, tents, camping facilities. If Immovable property partly used for business and partly for residence is deemed to be commercial.

I think the above given answer is wrong. As this is now liable to service tax under "Renting of Immovable Property" service

YES, SERVICE TAX IS APPLICABLE ON RENTING OF IMMOVABLE PROPERTY PROVIDED IT HAS BEEN RENTED FOR BUSINEES OR COMMERCE PURPOSE i.e AS A COMMERCIAL PROPERTY. HOWEVER THERE ARE SOME EXCLUSIONS e.g. VACANT LAND ETC. SO I WUD SUGGEST U READ SECTION 65(105)(zzzz).

yes service tax is applicable on rent a immovable property.but tds is not applicable on service tax amount
