Please Help: VAT Payable by builders

Under MVAT as per the notification dated 09.07.2010, the builders are liable to pay tax @ 1% on agreement value for the agreements after 01.04.2010. Can any one enlightne me about the legal standing before this notification. And wheteher such builders are liable to pay WCT Tax for the earlier period, i.e., before 01.04.2010.
Its very urgent.
