A Complaint for Professional Misconduct and abuse of official position has been filed with the Secretary ICAI, against CA. Raj Chawla, presently NIRC Vice-Chairman. Since last several months Mr. Chawla is grossly violating the code of conduct for the professionals.
Secretary ICAI, has acknowledged the complaint and apprised the complainant that the complaint has been forwarded to “DISCI PLINARY DIRECTORATE OF ICAI” for necessary action.
Mr. Chawla through various groups, sends e-mails, which apart from few professional updates, contains his firm name, address, and phone numbers. These mails also contains his official designation “Vice-Chairman NIRC” and solicitation of cost audit work for his wife, who is CMA. In one of the recent mail, Mr. Chawla advertised and solicited “XBRL” work, with name of the contact person and his telephone number.
Even, in one of the recent news letter of NIRC, Mr. Chawla, abused his official position as Vic -Chairman of NIRC, and got published an article of his wife, who is CMA. Main grievance of the complainant was that if any ordinary member makes any violation, even if unknowingly, he is subject to professional misconduct, but these elected representatives are making open and continuous violations and doing professional misconduct, abusing their official position, no body takes any action against them.
Quite some time, complainant, suggesting the ICAI, to have separate code of conduct for the elected representatives, which may punish them for any misconduct, any violation, any abuse of their official position.
