Respected sir, there is an indian company ( ab pvt ltd) subsidiary of foreign company ( xy) not having a PE in india. now XY incur expenses of fright & computer maintenance and issue a debit note to AB pvt ltd is AB Pvt ltd liable to deduct TDS on the same, and if yes at wht rate. or TDS is not deductible foreign co is based in dubai

07-Sep-2012 , 11:23:39 amin the case of freight charges there would be no TDS. however on computer maintenance there would be TDS depending on the country to which the payment would be made. It would be covered under Section 9(1)(vii) of the Act under "fees for technical services". However the applicable DTAA should also be seen and decided.
