NO, SERVICE PROVIDER CAN NOT COLLECT IT. THE LIABILITY IS ON SERVICE RECEIVER'S PART , BUT SERVICE PROVIDER CAN COLLECT HIS PART OF SERVICE TAX.

17-Jan-2014 , 04:18:18 pmService tax would be charged in the bill only by the person liable to pay service tax under the act. In case of Reverse charge mechanism, since the liability to pay tax is on service receiver, no service tax can be charged in the bill by the service provider. In case of Joint reverse mechanism, service tax would be charged in the bill to the extent service provider is liable to pay.

18-Jan-2014 , 12:36:13 pmYes Service Provider can collect the service tax in the bill from service receiver for the services falling under reverse charge mechanism but only his portion. i.e. for the portion for which he is liable to pay service tax. But where 100% liability is of service receiver then in that case he cannot charged anything on account of Service Tax.
