Q. > Please Help: Service Tax Return
When amount is received on advance basis on yearly basis on which Service Tax is paid @ 14% on July,15. Now Invoice raised every month. When Invoice is raised for April,16 then rate is changed to 14.5% on which assessee pays additional service tax @ 0.5% on account of Swachh Bharat Cess. How to reflect it in Service Tax return.

11-Mar-2017 , 08:34:18 pmIn this situation we have to apply point of taxation rules as per the finance act 2014. As per Rule 4 of POT Rules is based on the date of Invoice, payment and entering into the agreement. So, if any two of the above were happen before the rate change then old rate will applies, otherwise new rate applies.

07-Apr-2017 , 08:50:09 amWhen Service income is already reflected in July 2015, then not need to show again in April 2016, only charge and deposit SBC is sufficient. Also Please make note any where for remember that treatment.
