since when it apply. if a have not filed since 1990, since shen i need to file now.

As per the provision of Companies Act form 23B (appointment of auditor)should be filed within 7 days from the AGM. As per the recent amendment if 23b is not filed within the prescribed time them balance sheet cannot be filed with ROC.
