can employee claim hra exemption if pay the rent to his wife. the house is in the name of his wife and his wife shows the income from house property( the rent recived from her husband) in ITR.Please mention the section for this or notification if any as per income tax act 1961

Lots of People cliamed by paying rent to wife but as per my personal opinion he can cliam deduction by paying Rent to Wife. He can claim to Mother, Father but not wife.

10-Jan-2012 , 09:37:56 pmThis is a clear case of Tax avoidance, which, though not involve any penalty, will not be allowed to the assesses. in my opinion you should advise your client not to go via this route of income diversion.
