Q. > Please Help: TDS on Foreign Payment for Exhibition
Whether the TDS is applicable on payment for exhibiton to a foreign company who has no place of business in India, and have double taxation agreement with India.

Dear Mr. Jain, Yes the TDS will be applicable on payment for exhibition to a foreign company even if there is no place of business in india of the foreign company. He can take the benefit of tax deducted in india in his country as the double taxation agreement is there. The rate of Tds will also depend on the DTAA agreement with the india of that foreign country.
One more thing you should keep in your mind at the time of making payment to the foreign company that the foreign company must have indian PAN otherwise the rate of TDS will be 20% instead of the actual rate...
The exact answer can be given if the concerned foreign country name is there.
