Q. NOC - Previous Auditor - One client has been appointed a our firm as Tax Auditor as well as MVAT Auditor. Client had issued appointment letter in this regard. Our firm had communicated with previous auditor and obtained NOC from him for both Tax Audit and MVAT Audit. But now the client has hand over MVAT audit to same pravious auditor from whom NOC has been taken for Tax Audit and MVAT Audit. That auditor has completed the MVAT audit without communication or without obtaing NOC from us. The query is : -

1. Whether it amounts to professional misconduct under our ethics that that auditor completed MVAT audit without communicating with us or obtaining NOC from us?

2. If yes, then what is procedure to be followed for filing complaint and taking disciplinary action against such member?

Q. Provision made u/s 36 (1) (viia) of I.T. Act - In a rural bank, bank has made a provision u/s 36(1)(viia) of The income tax against its rural bank advances few years ago and reduced the profit of that year accordingly. the Provision kept remain as it is in the balance sheet for some year, now the management of the bank wants to revert back the provision and wants to increase the profit even if there is no recovery in NPA Accounts.
Please suggest me that written back of provisions made in earlier year is valid as per law and Accounting Standards. Please tell me that as a auditor, what should I do? Should I Qualify my report and how can I qualify my report? Please give your valuable suggestion as per Law and Relevant Accounting Standards. If there is any Circular of RBI or NABARD in this regard, then you are requested to Please Provide Me that.

Audit - There is a private limited company who has commission income from shipping companies.it has also registered a company of dairy products as sub unit. but in the F.Y. 2012-13 there is no income in the sub unit as its construction is work in progress. So how to account for it is consolidation of accounts apply for this. Whether sub unit is considered as subsidiary company. Q. Sign the Balance Sheet at individual name - I have to sign the statutory reports of the company. I have not applied for the firm name yet. Please tell me can i sign the balance sheet at an individual name and how it should be presented in the balance sheet.
