Q. service tax - one of my client is work for tuition classes. He is take franchise from a reputed company. between both of them a contract for income sharing. franchise co charge income + service tax from my client and no bill raised for this and my client take fees from student + service tax on whole income.

so my query is that on which part service tax is paid by my client, which is whole fees or only his share??

LEGAL ADVISORY SERVICES - Respected Sir, My query is regarding the service tax matter of Legal Advisory Service that One of my client is Partnership Firm and he receives a services from the Legal and advisory the P.Y. Q. Service Tax on construction - I have little doubt regarding the service tax applicability on construction business.

1) Is there an option with builder to go with Notification 26/2012 @ 75% or 70% abatement on gross value including the value of the land. OR

2) With notification 24/2012 wherein as per Rule 2A(i) or 2A(ii)

As there are two business models in this industry whereby

1) Builder will sale undivided share in land to buyer and enter into construction agreement on the same.
2) Builder will enter into agreement for sale on the completion of construction and collecting installment from the buyer at predetermined intervals.

My questions are :

1) Do i have an option as builder to chose notification in 24 or 26 ?

2) On the basis of above business models, if the 1st model is in existence, as a builder can i opt for notification 24/2012 as such model is purely works contract ?

3) And if 2nd model is in existence, can as builder i opt for notification 26/2012, as its agreement for sale including land also for which my Gross Revenue charged would include Land value also ?

My doubt is whether an assessee has to pay service tax on the Grossed up TDS portion were the service is imported one and the service receiver is liable to pay the Service tax and bear all TDS related liabilities.

Q. Service tax on Maintanance charges collected by RWA from its members. - 1. What was the implication of service tax on maintenance charges collected prior to 2012? When negative list was introduced in July 2012, many experts started discussing and advising societies to take registration numbers. This brought us to the presumption that no service tax was applicable to societies prior to that. So what was the exact position prior to that or what was the exact change that was brought in which made the experts start discussing about it so seriously?
2. After 2012 it was notified that if per month per member contribution of any or some members of a RWA exceeds five thousand rupees, the entire contribution of such members whose per month contribution exceeds five thousand rupees would be charged service tax. But in January 2015, there was an appeal filed with CESTAT and the tribunal delivered a judgement based on the principle of mutuality stating that there is no service tax liability. And thus news started flashing that no service tax is chargeable on maintenance charges by any of the co-operative societies in Maharashtra. What is the legal stand thereof as on today?
